Terms of service

1. Purpose
These terms govern the contracting and use of the Terrinde service (hereinafter, "the Platform"), cloud-based farm management software that lets each customer company manage its plots, landowners, activities, irrigation, costs, stock, seasons and other farm information from a private access isolated from other customers.
2. Parties
These terms are entered into between Norberto Berrueco Betoré (tax ID 73229777P), owner of Terrinde (see the Legal notice), as service provider, and the company or individual contracting access to the Platform (hereinafter, "the Customer").
3. Registration and access to the service
The Customer signs up by itself on the website's sign-up page, giving the name of its farm or company, its contact details and a password, and confirming its email address. Terrinde may also register a Customer directly after a commercial agreement. Registration creates an administrator account, whose credentials the Customer must keep safe with due care. Registration includes a free trial period, of the length shown on the website at the time of sign-up and with no card required; once it ends, a plan must be contracted to keep using the Platform. The Customer is responsible for all actions carried out from its user accounts, and for keeping up to date the details of the people it grants access to.
4. Description of the service and availability
The Platform offers, among others, the following features: plot and map management, landowners, activities and jobs, irrigation, machinery/labour/service costs, stock and products, season analysis, and document management. Terrinde will endeavour to keep the service continuously available, although it does not guarantee 100% uninterrupted availability. Maintenance work that may affect availability will be announced with as much notice as circumstances reasonably allow.
5. Price and payment
The price of the service is the one published on the website at any given time for the plan contracted by the Customer. Published prices include Spanish VAT. Payment is charged in advance, monthly or yearly depending on the option the Customer chooses when contracting, by credit/debit card through the Stripe payment gateway, and renews automatically for equal periods until the Customer cancels. Prices may be updated; the Customer will be notified sufficiently in advance before any change takes effect.
6. Term, renewal and cancellation
The contract is for an indefinite term and has no minimum term: the Customer may cancel at any time from its own account or by contacting Terrinde. Cancellation takes effect at the end of the period already paid for (the current month or year): until then the Customer keeps its access, the subscription does not renew and the unused part of the period is not refunded. On cancellation, Terrinde will deactivate the Customer's access as provided in clause 8.
The service is aimed at professionals and businesses in the farming sector, who contract it for their activity. The free trial period lets you get to know the Platform before paying anything.
7. Customer's obligations
- To keep the login credentials safe with due care and not share them with unauthorised third parties.
- To use the Platform lawfully, without attempting to access other customers' data or to breach the security of the system.
- To ensure that the data it enters on the Platform (plots, landowners, employees, etc.) is truthful and lawful.
- To comply with the data protection rules applicable to it regarding third-party data (landowners, workers, customers) that it enters on the Platform.
8. Ownership and protection of the Customer's data
The farm data the Customer enters on the Platform (plots, activities, costs, landowners, workers, etc.) belongs to the Customer. With regard to this data, Terrinde acts as data processor under article 28 GDPR, and undertakes to:
- Process the data only to provide the contracted service and following the Customer's instructions.
- Not disclose or transfer this data to other customers of the Platform or to unauthorised third parties. The Platform's architecture technically isolates each customer company's data.
- Apply appropriate technical and organisational measures to protect the confidentiality, integrity and availability of the data.
- At the end of the contract, make the Customer's data available to it (or export it) and delete it as set out in clause 9, unless there is a legal obligation to keep it.

9. Export and deletion of data at the end of the contract
The Customer may request an export of its farm data at any time. When the contractual relationship ends, the Customer will have a reasonable period to request the export of its data, after which Terrinde may delete it, unless there is a legal obligation to keep it for a given period.
10. Intellectual property of the software
Terrinde retains ownership of the Platform, its source code, design and brand at all times. Contracting the service grants the Customer a non-exclusive, non-transferable right of use limited to the term of the contract, without any transfer of intellectual property rights over the software.
11. Limitation of liability
Terrinde will not be liable for damage or loss arising from improper use of the Platform by the Customer, from inaccuracy of the data entered by the Customer, or from service interruptions caused by circumstances beyond its reasonable control (force majeure, failures of external infrastructure providers, etc.).
12. Changes to the terms
Terrinde may amend these terms to adapt them to changes in legislation or in the service, notifying the Customer with reasonable notice before they come into force.
13. Governing law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute arising from their interpretation or performance, the parties submit to the courts of Zaragoza, unless consumer law establishes a different mandatory jurisdiction.
